Terms of Service
1. About DronePoint
DronePoint is a web-based mission planning tool that generates KMZ mission files for compatible DJI Fly and WPML workflows. In these terms, "DronePoint", "we", "us", and "our" refer to the operator of DronePoint.
DronePoint is independent software. It is not affiliated with, endorsed by, sponsored by, or approved by DJI Technology Co., Ltd. DJI, DJI Fly, and related product names are trademarks of their respective owners.
2. Eligibility and Accounts
You may use DronePoint only if you can form a binding contract and may lawfully operate drones or plan drone operations in your jurisdiction. Free use does not currently require an account. Paid access may require a license key, checkout record, or customer portal account managed by our payment provider.
You are responsible for keeping any access key confidential. If you believe your key has been compromised, contact us promptly.
3. Aviation Compliance and Safety
You must not use DronePoint for illegal, unsafe, or harmful operations. You must verify altitude, terrain, obstacles, airspace, weather, battery reserve, aircraft configuration, firmware behavior, and return-to-home settings before flight.
Generated files may contain errors or may behave differently across aircraft, controller, app, firmware, or regional configurations. You must test cautiously and keep manual control available whenever possible.
4. Acceptable Use
You agree not to:
- Use DronePoint to plan unlawful, dangerous, or unauthorized flights.
- Interfere with, overload, scrape, reverse engineer, or attempt to bypass security for the service.
- Share paid access keys publicly or resell access without written permission.
- Upload or transmit malicious code or unlawful content.
- Use DronePoint in a way that infringes third-party rights or violates applicable law.
5. Paid Products and Lemon Squeezy
Paid DronePoint products may be sold through Lemon Squeezy, which acts as merchant of record or reseller for supported transactions. Lemon Squeezy may handle checkout, payment processing, sales tax, invoicing, refunds, chargebacks, fraud checks, and customer portal functions.
By purchasing a paid product, you also agree to Lemon Squeezy's applicable buyer terms and privacy terms, available from the Lemon Squeezy checkout and website. If there is a conflict between these terms and Lemon Squeezy's checkout or buyer terms for payment, tax, billing, refund processing, or chargeback handling, Lemon Squeezy's terms control for those payment-related matters.
Prices, features, billing periods, and renewal terms are shown at checkout. Subscription access continues until cancelled, expires, or is terminated under these terms.
6. Refunds and Cancellations
Our refund rules are described in the Refund Policy. Subscription cancellations stop future renewals but do not automatically refund past charges unless the refund policy or applicable law requires otherwise.
7. Intellectual Property
DronePoint software, design, text, logos, and documentation are owned by DronePoint or its licensors. You may not copy, modify, redistribute, sell, sublicense, or create competing services from DronePoint except as expressly allowed by law or written permission.
You retain ownership of mission inputs you create, including polygons, waypoint paths, mission names, and settings. You grant us the limited rights needed to process those inputs, generate output files, troubleshoot the service, and maintain security.
8. Third-Party Services
DronePoint may use third-party services for map tiles, geocoding, elevation data, fonts, hosting, and payment processing. Those services are governed by their own terms and privacy policies. Third-party data may be incomplete, outdated, unavailable, or inaccurate.
9. No Professional Advice
DronePoint does not provide aviation, surveying, legal, insurance, engineering, or safety advice. Calculations such as spacing, overlap, GSD, terrain following, and waypoint counts are estimates and must be independently verified for your aircraft, sensor, site, and use case.
10. Disclaimers
DronePoint is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the service will be uninterrupted, error-free, secure, compatible with every aircraft or firmware version, or that generated files will be safe or suitable for any particular operation.
11. Limitation of Liability
To the fullest extent permitted by law, DronePoint will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, property damage, personal injury, regulatory penalties, failed missions, or aircraft loss arising from use of the service or generated files.
To the fullest extent permitted by law, our total liability for any claim relating to DronePoint is limited to the amount you paid for the service in the 3 months before the event giving rise to the claim, or USD 100 if you used only the free service.
12. Termination
We may suspend or terminate access if you violate these terms, misuse the service, create safety or security risk, fail payment, or if required by law or a payment provider. You may stop using DronePoint at any time.
13. Changes
We may update these terms from time to time. The effective date will be updated when changes are posted. Continued use after changes means you accept the updated terms.
14. Governing Law
Unless a mandatory consumer law says otherwise, these terms are governed by the laws of Israel, and disputes will be handled by courts in Israel.
